On July 22, 2004, the Law Enforcement Officers’ Safety Act of 2004 (Title 18 U.S.C. § 926C) was signed into law. This law allows qualified honorably retired law enforcement officers to carry concealed firearms nationwide without having to obtain a state issued concealed weapons permit. Additionally, the law sets forth the criteria that individuals must meet in order to qualify as law enforcement officers. United States probation officers qualify under the Act as law enforcement officers. However, pretrial services officers and probation or pretrial services officer assistants do not qualify under the Act. To be eligible for the benefits of the law, retired probation officers must have a photo identification card that indicates that they are retired law enforcement officers.
Therefore, pursuant to this law, the Director of the Administrative Office of the United States Courts (AO) has authorized the issuance of retired identification cards for retiring or retired probation officers. The retired identification card does not convey any law enforcement authority or official status to the retired individual. The card only serves to document a probation officer’s retirement status.
Identification cards may only be issued to retired probation officers who meet certain criteria.
Probation officers retiring from a United States probation office may make a request for a retired identification card to their chief probation officer after formal documents for retirement have been submitted. Retiring chief probation officers may apply for a retired identification card directly to Probation and Pretrial Services Office (PPSO).
Probation officers who retired prior to the approval of these procedures may apply for a retired officer identification card at the probation office from which they retired.
PPSO will be responsible for producing the retired identification cards and sending them to the chief who made the request.
